Terms of Use

Article 1 — Purpose

These Terms of Use (hereinafter "TOU") define the terms and conditions for using the website www.nexai.ma (hereinafter "the Site"), published by NexAI, an IT consulting and services company based in Casablanca, Morocco.

Accessing and using the Site implies full and unreserved acceptance of these TOU. If you do not accept these terms, please do not use the Site.

Article 2 — Definitions

• "Site": the website accessible at www.nexai.ma and all its pages and features.
• "User": any natural or legal person accessing the Site.
• "NexAI": the publisher of the Site, an IT consulting and services company specializing in cloud computing, artificial intelligence, and digital transformation.
• "Services": all services offered by NexAI, as described on the Site (Digital Workplace, Cloud Modernization, Data & Automation, Artificial Intelligence, Application Development, Support & Evolution).
• "Content": all elements present on the Site (texts, images, logos, graphics, videos, documents, etc.).

Article 3 — Site Access

The Site is freely accessible to any User with Internet access. Telecommunications network access and usage fees are borne by the User.

NexAI reserves the right to suspend, modify, or discontinue access to the Site, in whole or in part, at any time and without notice, particularly for maintenance or update purposes, without this giving rise to any compensation.

Article 4 — Description of Services

The purpose of the Site is to present the activities and services of NexAI, namely:

• Digital Workplace — Microsoft 365 deployment, Teams/SharePoint configuration, migration, training
• Cloud Modernization — Azure/AWS/GCP migration, application security, DevOps, FinOps
• Data & Automation — Power BI dashboards, process automation, real-time monitoring
• Artificial Intelligence — AI agents, chatbots, machine learning solutions
• Application Development — Custom business applications, from MVP to enterprise
• Support & Evolution — Annual maintenance packages, updates, and support

Information relating to the Services presented on the Site is provided for informational purposes. Any service is subject to a specific quote and service agreement between NexAI and the client.

Article 5 — Free Audit

NexAI offers a free audit including:

• Assessment of existing IT infrastructure
• Cloud readiness analysis
• Identification of automation opportunities
• Artificial intelligence recommendations

The audit request is made via the Site contact form or by email at contact@nexai.ma. The free audit does not create any purchase obligation. A detailed report is provided at the end of the assessment.

Article 6 — Intellectual Property

All Site Content is protected by Moroccan and international intellectual property laws, including Law No. 2-00 on copyright and related rights.

The Content is the exclusive property of NexAI or its partners. Any reproduction, representation, distribution, or redistribution, in whole or in part, of the Site Content by any means, without the express prior authorization of NexAI, is prohibited and constitutes infringement.

Trademarks, logos, and distinctive signs displayed on the Site are the property of NexAI. Their use without prior authorization is prohibited.

Article 7 — User Obligations

The User agrees to:

• Use the Site in compliance with these TOU and applicable Moroccan laws
• Not compromise the security of the Site (intrusion attempts, malicious code injection, denial of service attacks, etc.)
• Not systematically collect or extract data from the Site (scraping, data mining)
• Not reproduce, copy, or distribute Site Content without authorization
• Provide accurate and complete information when using contact forms
• Not use the Site for illegal or unauthorized purposes

Article 8 — Personal Data

8.1 Collection and Processing

NexAI collects personal data through the use of the Site, particularly via contact forms. The data collected includes: name, email address, phone number, company name, and any information voluntarily provided.

8.2 Purposes

Data processing is carried out for the following purposes:

• Managing contact and information requests
• Providing requested services
• Sending commercial communications (with prior consent)
• Improving the Site and services

8.3 Legal Basis

Processing is based on:

• User consent (contact form, audit request)
• Legitimate interest of NexAI (service improvement, prospecting)
• Performance of a contract or pre-contractual measures

8.4 Recipients

Personal data is reserved for the exclusive use of NexAI. It is not transmitted to any third party, except as required by law or with the User's consent.

8.5 Retention Period

Data is retained for 3 years from the last contact, unless a longer legal retention period is required.

8.6 User Rights

In accordance with Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data, the User has the following rights:

• Right of access: obtain confirmation that data concerning them is being processed
• Right to rectification: request correction of inaccurate data
• Right to object: object to processing on legitimate grounds
• Right to erasure: request deletion of data

These rights may be exercised by email at: contact@nexai.ma or by mail to the registered office of NexAI in Casablanca.

8.7 CNDP

NexAI commits to complying with applicable regulations on personal data protection and to making the necessary declarations to the National Commission for the Control of Personal Data Protection (CNDP).

Article 9 — Cookies

9.1 Definition

A cookie is a small text file stored on the User's device when visiting the Site.

9.2 Types of Cookies Used

• Technical cookies — Site functionality, navigation (duration: session)
• Analytics cookies — Audience measurement, traffic statistics (duration: 13 months max)
• Third-party cookies — Integrated services, forms, analytics (duration: varies)

9.3 Cookie Management

The User may configure their browser at any time to accept or refuse cookies. Refusing technical cookies may affect the proper functioning of the Site.

Article 10 — Hyperlinks

The Site may contain links to third-party sites (Microsoft, AWS, Google Cloud, LinkedIn, etc.). NexAI has no control over these sites and disclaims any responsibility for their content, data protection practices, or availability.

Article 11 — Liability

11.1 NexAI's Liability

NexAI strives to ensure the accuracy and currency of the information presented on the Site. However, NexAI cannot guarantee the accuracy, completeness, or timeliness of the information made available.

NexAI shall not be held liable for:

• Direct or indirect damages resulting from the use or inability to use the Site
• Interruptions, malfunctions, or unavailability of the Site
• The presence of viruses or any harmful element on the Site despite precautions taken
• Information contained on third-party sites accessible via hyperlinks

11.2 Force Majeure

NexAI shall not be held liable for failure to perform its obligations in the event of force majeure as defined by Moroccan law.

Article 12 — Modification of TOU

NexAI reserves the right to modify these TOU at any time. Modified TOU take effect upon publication on the Site. Users are invited to regularly review the TOU.

The date of the last update is indicated at the top of this document.

Article 13 — Applicable Law and Jurisdiction

These TOU are governed by Moroccan law.

In case of dispute relating to the interpretation or performance of these TOU, the parties commit to seeking an amicable solution. Failing amicable agreement within 30 days, the dispute shall be submitted to the competent courts of Casablanca, Morocco.
